Kerala 'Love Jihad' case: SC says 'consent of girl is prime, she is a major'

The court also observed that the consent of the girl is prime and in this case she is a major. The petitioner said that when the girl was studying in a dental college, she fell trap to a sinister radical Islamic design. Chief Justice Dipak Misra said that it will be in open court hearing around 3 pm on November 27.

In a significant turn of event related to Kerala's alleged "Love Jihad" case, the Supreme Court on Monday asked the parents of Hadiya to present her version before the apex court next month. The case relates to 24-year-old Hadiya's battle to re-unite with her husband after the Kerala High Court annulled their marriage on May this year, following a habeas corpus petition filed by her father Ashokan KM.

Hadiya's marriage to Shafin Jahan had been annulled by the Kerala High Court in May on a petition by her father.

The SC said if it suspected any indoctrination, it has powers to direct her detailed examination by appropriate authorities. I am sure I will be killed tomorrow or the day after. My father is getting angry, I know.

Divan said a radicalised, indoctrinated person can not be said to have a free will. There is no law stating that a person can't marry a criminal.

Misra, though, said, "The court does not go by the pulse or impulse of the society, but the law of the land". The NIA said when a person is indoctrined to hate her own religion and parents, there is little to determine whether free will was exercised. "They have students, preachers, psychologists etc and they radicalize impressionable minds. The question is do courts respond to such radicalization or do they remain silent?" It is alleged that the woman was recruited by Islamic State's mission in Syria and Jahan was only a stooge.

SC refused plea of Hadiya's father for holding of in-camera proceedings on November 27th.
